The Spanish Law on Assisted Human Reproduction Techniques regulates surrogacy in its Article 10, rendering any related contract null and void in Spain. However, it is possible to carry out a surrogacy process abroad in countries where this practice is legally regulated. The destination country can be chosen according to the circumstances of each case, always opting for jurisdictions where the practice is permitted. Depending on whether the parents are a heterosexual couple, same-sex couple, or single individuals, and considering their marital status, one country may be more suitable than another. The choice of country will determine how the newborn will be legally recognized and the procedures that will lead to the recognition of the child as the sole child of the commissioning parents or intended parents.
