In order for a surrogacy process to be legal and not to present us with obstacles with the administration in any of its phases, you must rely on a law firm with a high knowledge of the legislation of assisted reproduction of the selected country and the medical situation of our clients.
Article 10 of the Spanish Law on Assisted Human Reproduction Techniques regulates gestational surrogacy, rendering null and void any contract in this regard in Spain. However, it is possible to carry out a surrogacy process outside our borders in countries where this practice is regulated.
The country of destination should be chosen according to the circumstances of each case and always in jurisdictions where this practice is permitted. Depending on whether it is a heterosexual or homosexual couple, single people and their marital status, it will be appropriate to go to one country or another.
The choice of country will determine the manner in which the newborn will be recognized and the legal procedures that will lead to the recognition of the newborn as the only child of the commissioning or intending parents.
Good legal advice from the earliest stage of the process is necessary to avoid surprises along the way. - Evaluation of the interested person or couple in relation to the requirements necessary to execute a surrogacy process in the interested country.
- Contracts with gamete donors.
- Contracts with clinics and agencies in the destination countries.
- Trust management.
- Formalization of agreements with the pregnant women that will help us in this process.
- Evaluation of the medical processes that are carried out during the process comply with the regulations and are specified in binding contracts.
- Choice of appropriate medical insurance to cover any medical costs.
- Birth registration of the newborn with the corresponding legal proceedings in the country of destination and/or Spain, as the case may be.
